Kampala, Uganda: International Crimes Division that sits in Kololo resumed hearing cases against Members of Parliament for Kawempe North Muhamad Ssegirinya, Allan Ssewanyana of Makindye and other five.
Last time the Judge who was hearing this case, Elizabeth Alividza was changed and taken to Land Division.
By the time Ms. Alividza left for Land Division, the evidence was ready and according to Government Prosecutor, Richard Birivumbuka, what was remaining was giving the ruling but it was not possible on 1st, sept, 2022 because there was no Judge and the Judiciary was still looking for the replacement to handle the process.
Today, at 10am, Court has resumed with Alice Komuhangi Khaukha replacing Elizabeth Alividza however Counsel Geoffrey Turyamusiima has asked Court to release Muwonge Jude because he possesses no document that entitles him to be in Court.
Counsel Tuyamisima has put this request earlier during the time of Judge Alividza but nothing was done regarding the matter.
Ms. Komuhangi asked Government Prosecutor how Muwonge was brought to prison for this long but Richard Birivumbuka had no clear answer at all.
Ms. Komuhngi asked the one in charge of transporting prisoners how Muwonge happened to be in court and responded that he brought him together with others because they all come from Masaka.
Muwonge revealed that he informed former Judge Alividza that he was wrongly in Court but this did not necessitate him to be released as Ms. Komuhangi said that that she’ll first consult from Masaka Court then he will be released.
Ms. Komuhangi adjourned Court till 28, Sept/ 2022 however lawyers of the prisoners asked the judge to merge the two cases, the one of Masaka and Kampala to be heard at once which was opposed by government prosecutor.
Ssalongo Erias Lukwago, the lawyer of the accused told journalists in an interview that refusing to merge the two cases is an trick of completing one case and still detain them which he said they will not accept it.
James Mubiru, the LCV Councilor for Rubaga North has affirmed that as concerned citizens and leaders, will fight unceasingly till their people are freed citing that for all this time the other party has failed to provide evidence.
