RE: COMPLAINT VIDE MASAKA CRB 124/2022.
My Lord, we act for and on behalf of TUSHABE BRUCE NZABANITA President Volunteer Uganda extra Ltd herein the complainant in this matter and the accused person in the above referenced case upon whose instructions we address you as here under;
1.That the complainant herein Namere Justine in the case in issue {the alleged CEO of the true Minabuddu TV station (TMTV LTD) A non existing and fictitious TV station allegedly Located at Masaka City) falsely and maliciously reported our client to police that he forged academic qualifications while applying for a job at her TMTV station which was not true and instead she is the one who forged the same alleged documents in issue in his names thinking that he did not possess one whereas not.
It is alleged the complainant colluded with police in greater Masaka to maliciously prefer the case of forgery against him. Our client informs us that he has a genuine document in issue. How could he forges what he has even when the complainant never advertised that such document is required?

- That our client through his advocates of HILLS ADVOCATES AND SOLICITOTS addressed a complaint to your office particularly to be addressed by you as a person. Refer to theirs REF.HAS/GEN/06.06.2022 This complaint was very detailed and it was received by your office on 6th June 2022.That this complaint referred to two files one being this one as per deference and another MASAKA CRB/203/2022 which was about offensive communication pursuant to section 25 of computer misuse Act also maliciously fabricated by the same complainant (Namere Justine) in collusion with police against him.
- That in that complaint (our client) prayed to you to call the two files, peruse them personally and advise accordingly and also give an appointment to his lawyers to meet you on the same, where you promised his lawyers that you would call all of them. We appreciate you attended by appointment to the lawyers (HILLS ADVOCATES) of the complainant.
You called one file about offensive communication which was in court which you referred to further inquiries. This indeed was justice rendered. However, you never called the file for forgery (CRB 124/2022) which gave an opportunity to the regional DPP Masaka herein Jenifer Amumpire to collude with complainant (Namere Justine) and police, eventually, Regional DPP sanctioned the fille herself instead of Resident chief state attorney (Birivumbuka Richard).
This case was handled by Cps Masaka. There was no complaint on it this created suspicion for the file to have been unusually sanctioned by Regional DPP instead of the rightful office. That it is against this background that our client reported a case of mishandling of police file and abuse of office to the office of IGG pending a report about the same. Our client was not satisfied on the way the file was handled and as to why his second file of forgery was not called and perused by you.
- We are allegedly informed by our client that the order for sanctioning the file arose from Deputy DPP herein ELEM-OGWAL CHARLES. This was after the Regional DPP Masaka stealthily out of order and procedure took the file under her armpits and gave it to deputy DPP even when there was no complaint on it calling that file to Kampala.
This is unusual and surprising. In any case this was a small offence of forgery whose maximum sentence in event of conviction is just 7 years of imprisonment. How could such a file attract the intervention of such high profiled officer office of DPP to the level of deputy DPP. This was intended injustice and prejudice perpetrated by the offices mandated to dispense justice.
- That notwithstanding, since the file was irregularly and maliciously sanctioned in the month of June 2022, the stake holders in prosecution of this file have been in bed sleeping' with file now about seven(7) months down the road, the accused has never been arraigned to court. This is Irregular this time is so long to account for as it definitely defeats the intention and purpose of prosecution of this file.
We pray that this office should be cognizant that the complainant is cooking cases against our client for other reason like covering corruption case/scandals which his organization (volunteer Uganda ltd fights in Uganda particularly in greater Masaka where this office was put on notice in previous complaints and also to scare him from demanding his money (salaries) on contract between him and TMTV where the complainant is an alleged CEO. (A copy of the contract dated 27th day of October /2021 to work as political talk show/presenter is attached.

- Employee Benefits. Both parties will comply with Employer policy regarding employee benefits or as required by law.

- Confidential and Proprietary Information. In the course of employment, Employee will be exposed to confidential and proprietary information of Employer. Confidential and proprietary information shall mean any data or information that is competitively sensitive material and not generally known to the public, including, but not limited to, information relating to development and plans, marketing strategies, finance, operations, systems, proprietary concepts, documentation, reports, data, specifications, computer software, source code, object code, flow charts, data, databases, inventions, know-how, trade secrets, customer Iists, customer relationships, customer profiles, supplier lists, supplier relationships, supplier profiles. pricing, sales estimates, business plans and internal performance results relating to the past, present or future business activities, technical information, design, process, procedure, formula, or improvement. which Employer considers confidential and proprietary.
Employee acknowledges and agrees that the confidential and proprietary information is valuable property of Employer, developed over a long period of time at substantial expense and that it is worthy of protection.
- Confidentiality Obligations. Except as otherwise expressly permitted in this Agreement, Employee shall not disclose or use in any manner, directly or indirectly, any confidential and proprietary information either during the term of this Agreement or at any time thereafter, except as required to perform their duties and responsibilities or with Employer's prior written consent.
- Rights in Confidential and Proprietary Information. All ideas, concepts, work product, information, written material or other confidential and proprietary information disclosed to employee by Employer (i) are and shall remain the sole and exclusive property of Employer, and (ii) are disclosed or permitted to be acquired by Employee solely in reliance on other person except ill furtherance of Employer’s business.
Except as expressly provided herein, this Agreement does not confer any right, license, ownership or other interest or title in, to or under the confidential and proprietary information to Employee.
- Irreparable Harm. Employee acknowledges that use or disclosure of any confidential and proprietary information in a manner inconsistent with this Agreement will give rise to irreparable injury for which damages would not be an adequate remedy. Accordingly, in addition to any other legal remedies which may be available at law or in equity, Employer shall be entitled to equitable or injunctive relief against the unauthorized use or disclosure of confidential and proprietary information.
Employer shall be entitled to pursue any other legally permissible remedy available as a result of such breach, including but not limited to damages, both direct and consequential. In any action brought by Employer under this Section, Employer shall be entitled to recover its attorney’s fees and costs from Employee.
- Ownership of Work Product. The Parties agree that all work product, information or other materials created and developed by Employee in connection with the performance of duties and responsibilities under this Agreement and any resulting intellectual property rights are the sole and exclusive property of Employer.
- Termination. This Agreement may be terminated immediately by Employer for cause or in the event Employee violates any provision of this Agreement.
Employer’s Termination. In addition, Employer may terminate this Agreement and Employee’s employment: (Check one

… at any time and for any reason in accordance with applicable local, state, and federal labor laws. with notice as mentioned above. During the notice period, Employee and Employer agree to continue diligently fulfilling their duties and obligations in good faith with best efforts.
At the time of termination, Employee agrees to return all Employer property, including but not limited to computers, cell-phones, and any other electronic devices. Employee shall reimburse employer for any Employer property lost or damaged in an amount equal to the market price of each property.
The rights and obligations of the Parties set forth in(… Non-compete, … Confidentiality), Ownership of Work Product, Termination and Miscellaneous are intended to survive termination, and will survive termination of this Agreement.
- Miscellaneous.
- Authority to Contract. Employee acknowledges and agrees that Employee does not have authority to enter into any binding contracts or commitments for or on behalf of Employer without first obtaining the prior written consent of Employer.
- Governing Law. The terms of this Agreement shall be governed exclusively by the laws of the Republic of Uganda. However, in any case of a dispute stemming from this agreement, then the dispute will be first referred for mediation.
- Entire Agreement and Amendment. This Agreement constitutes the entire agreement between the Parties and supersedes all prior understandings of the Parties.
No supplement, modification or amendment of this Agreement will be binding unless executed in writing by both of the Parties.
- Notices. Any notice or other communication given or made to either Party under this agreement shall be in writing and delivered by hand, sent by overnight courier service or sent by certified or registered mail, return receipt requested, to the address stated above or to another address as that Party may subsequently designate by notice and shall be deemed given on the date of delivery.
- Waiver. Neither Party shall be deemed to have waived any provision of this Agreement or the exercise of any rights held under this Agreement unless such waiver is made expressly and in writing. Waiver by either Party of a breach or violation of any provision of this agreement shall not constitute a waiver of any subsequent or other breach or violation.
- Further Assurances. At the request of one Party, the other Party shall execute and deliver such other documents and take such other actions as may be reasonably necessary to give effect the terms of this Agreement.
- Severability. If any provision of this Agreement is held to be invalid, illegal or unenforceable in whole or in part, the remaining provisions shall not be affected and shall continue to be valid, legal and enforceable as though the invalid, illegal or unenforceable parts had not been included in this agreement.
- No Assignment. The interests and responsibilities of Employee are personal to Employee and cannot be assigned.
