Issues.
- Whether there was Notice to terminate!
- Whether there was a fair hearing in the termination process!
- Whether there was illegal/unlawful termination!
- Whether claimant is entitled to remedies!
Claimant says;
I was employed by centenary bank as a personal banker trainee and posted to Ntungamo branch on a letter dated 15th September 2022 and started working on 23 rd September 2022 as agreed by documentation. The letter directed that through appraisal process, I will be later confirmed in service.
On 1st June 2022, a letter was received deferring my confirmation as a personal bank trainee by MHRC meeting that was held on 18th May 2022 to 18th August 2022 to acquire the required case load and riding permit.
Another letter was received dated 20th June, 2022 through the branch manager Ntungamo Mr. Kasozi David Matovu signed and stamped by him showing that the same MHRC meeting that sat on 18th May 2022 and deferred my confirmation had finally approved my confirmation from personal bank trainee to personal banker and a confirmation letter was received through the branch manager Ntungamo.
It was a disgrace and disappointment on a letter dated 13th July, 2022 was sent through my immediate supervisor Mr. Tusemererwa Jacob directing that I have been deferred on confirmation by the same MHRC meeting that had confirmed me in service by a letter dated 20th June, 2022 and deferred my confirmation from 15th June, 2022 to 15th September, 2022 to acquire a riding permit and acquire a required case load. I therefore worked hard to acquire a riding permit and got it. I was confirmed by letter dated 20th June, 2022 a date higher than the deferring date of 15th June 2022 meaning the letter dated 20th June 2022 confirming me had superseded the day I had been deferred from 15th June 2022 to 15th September 2022.
The letter Dated 13th July, 2022 directed that it supersedes the letter confirming me in service yet the letter that was confirming me in service was dated 20th June, 2022. This nullifies the letter dated 13th July 2022.
It was another disgrace and disappointment when I received a letter dated 24th October, 2022 on the 4th November, 2022 having returned from my biological brothers’ funeral directing me that I had been terminated as a personal banker trainee yet I had been confirmed in service as a personal banker not a personal banker trainee with evidence of the confirmation letter. On another evidence to show that I was a confirmed staff, I had acquired a salary loan of 5.5M which is only a privilege given to confirmed staff and not trainees. This is evidenced by the salary loan documentations and the financial statement. To my thinking, this nullifies my termination as a personal banker trainee since I was already a confirmed staff in service of Centenary bank.
I was shocked terminating my service yet I had not been given any notice that I was to be terminated. I was also shocked that the MHRC never sent any call for a fair hearing asking me of the performance allegations and what the cause was.
In my objection, all the letters that were received deferring me upon confirmation directed me to acquire a case load of 120 and a riding permit but not NPR target of 2% as the termination letter shows that reason for termination is failure to acquire NPR target of 2% yet the deferring don’t explain anything about NPR target of 2%.
Further to that, upon clearing to exit the bank duties, my immediate supervisor Mr. Tusemererwa Jacob refused to clear me insisting that he was still new in Centenary bank and didn’t know how it is done and procedures to follow.
I therefore seek for the available remedies within your jurisdiction before I opt for industrial court action.
