Kampala, Uganda: 975 students from Kampala University Juba College were left in untold confusion after Uganda’s High Court ruling did not meet their requests in the suit against Kampala University which they claimed that it was supposed to award them academic honors after their completion which the University disowned.
A section of students from Kampala University Juba college petitioned the High Court of Uganda in miscellaneous cause No. 0129 of 2022 seeking for several declaration and orders against Kampala University that included,
that the denial of the college by Kampala University was illegal and irrational,
that failure to graduate students on 23rd June/2022 was unfair, illegal and procedurally flawed,
an order of mandamus doth issue directing the university to award them the requisite transcripts and certificates.
that the university should incur general damages, exemplary damages and costs of the suit and others.

Genesis of the case.
975 students were conned by one Faizal, admitted to pursue different academic programs at the College in Juba, paid all fees and fulfilled all academic requirements and were cleared by the College to attend the Kampala University’s 19th Graduation Ceremony that took place on 23rd June 2022 at Main Campus, Ggaba.
These claimed to have travelled to attend graduation but were denied external clearance by the University and were subsequently not graduated on 23rd June/2022.
Addressing at a press conference held on Thursday 27th /2022 at main campus in Ggaba Prof. Dr. Badru Ddungu Kateregga the Vice Chancellor of Kampala University told Umoja Standard that by a board resolution dated 17th February 2016 resolved to establish a branch or study center in Juba- South Sudan and made efforts tor regularize operations in South Sudan.
Prof. Kateregga said however their efforts towards being licensed were frustrated and so the University decided to officially suspend operations of the college by the letter dated 23rd/February 2017 and that the suspension has since then not been lifted.
He further stated that applicants were not students of the University and so there was no way of vetting or clearing them for graduation and award them transcripts and certificates.
Represented by Counsel David Kaggwa of Kaggwa and Kaggwa Advocates and Counsel Mohammed Ssebandeke of Edward Ocen Advocates Kampala University through an affidavit by its Vice Chancellor Amb. Prof. Badru Dungu Kateregga opposed the application.
On 19th October 2022, Hon. Justice Boniface Wamala delivered a ruling. It held that the applicants did not produce any documentary evidence indicating the lifting of the suspension which had been communicated not only by the administrators of the Juba College but also to the stakeholders in the government of South Sudan.
Justice Wamala agreed with Kampala University’s submission that a suspension that was communicated in such a manner could not be lifted by implication especially so the condition precedent had not been fulfilled.
The ruling also stipulated that it is not in public interest that the university should graduate and award academic certificates to persons whose admission and instruction did not superintend.
The court finally held that the applicants were not entitled to any of the prayers claimed in the application and accordingly the application wholly failed and was dismissed with costs to the respondent.
